The evil doer is proven to be a jerk. I don't expect a big monetary settlement, but even if its a buck, him knowing he is wrong is all that matters.

This is the best win the Marist men have had in over a year! By the time this whole case is over the only winners will be the law firms that represent Marist and Matt Brady. JMU & the state of Virginia have attorneys on staff so for them it's just another day at the office. Marist gets the satisfaction that they were right. JMU & Virginia will take this fight to the next level.
In the future it will be much more difficult for any college coach to leave like MB did. This is actually precedent setting.
How much does Marist really think they can extract from Matt Brady? Another win!

The problem Yankee the Jerk has not been proven wrong - the Case against her who shall not be named is still pending.
The other problem is that although we won against JMU - it was based on a default judgement - so we didn't really win on an argument we won cuz other team failed to show up
Lets see where this goes

Way to take some of the fun out of it Nomar:). I should probably read about something before I commentate on it. They failed to show up? More of the incredulous attitude they have shown during the whole thing. They should be able to get every dollar Marist put into the recruits and maybe even the contract they had to pay Martin these past couple years. I think a fair settlement is somewhere in the 350,00-475,000 range. However, hopefully the court finds a way to stick it to em. Just better not be one of those, "you won, but no real monetary damages could be proven" deals.

it is funny Yankee that the JMU board seems to think this will affect us and how great Brady is for sticking with HIS recruits - but failing to acknowledge "his" players he left behind after telling them he had unfinished business.
And a team that has this great coach is blaming 2 injuries for a 20 loss season - but us blaming 4 recruits and a top transfer leaving is not why we had the season we did.
They are comical over there - let them drink the cool aid

Once Brady leaves next year after leading them to the semifinals of the CAA they will be saying we were right all along and be trashing the maggot as well.

Several agents have already commented that this clause is not in contracts they negotiate with the College/Univ on behalf of coaches they represent. They pointed out that Brady negotiated this contract himself.

Judge: Talk To Marist Posted 2010-08-06 By Mark Selig
HARRISONBURG - James Madison University will have four more months to reach a settlement with Marist College - or else.
If the two sides can't reach an agreement by then, New York state judge Charles D. Wood's office said Thursday that Wood will determine what JMU owes Marist, which successfully sued Madison in a case concerning men's basketball coach Matt Brady.
Attorneys for JMU and Marist met with Wood at his court in Poughkeepsie, N.Y. - where Marist is located - for approximately two hours Thursday morning in a conference that was intended to assess damages against Madison.
But Wood instead gave the parties more time to settle the case on their own, setting a hearing for Dec. 8 and 9. If JMU and Marist fail to settle before the hearing, principal law clerk Michael V. Curti said, Wood plans to determine what Madison will have to pay the small, private college.
"The judge encouraged both sides to enter into settlement negotiations," said Marist spokesman Tim Massie, who was not present at the conference but said he spoke to the Poughkeepsie school's lawyer Thursday afternoon.
"We'd like to work this out amicably," Massie said. "We've wanted to work this out amicably for two years."
Officials at Marist have said they tried to settle with JMU before filing a lawsuit last July. Madison has steadfastly refused to comment on the case.
Marist is suing because it alleges that Brady broke his contract - and that JMU encouraged him to do so - by maintaining contact with recruits after he left the Red Foxes for James Madison in March 2008. Four of those recruits eventually signed with JMU.
Wood issued a "default judgment" in favor of Marist on June 30 because JMU did not answer a motion to take the case to trial. In his ruling on another facet of the case, Wood said Marist "adequately articulated the elements for a claim of tortuous interference with a contract."
He then scheduled a conference for July 26 to assess damages, but postponed it until Thursday, ordering that both parties appear in person (rather than talk over the phone) at the New York Supreme Court of Dutchess County, which is similar to circuit or district courts in other states .
Although Wood ruled against JMU - and its co-defendant, the state of Virginia - he has not yet set a trial date for Brady's portion of the case, according to Curti. That case is separate because, unlike Madison, JMU's third-year coach filed a motion to take the lawsuit to trial.
A source said Brady's segment is still in the "discovery" phase, where information is disclosed and exchanged.
The ball seems to be in JMU's court. Because its decision-makers aren't talking - JMU athletic director Jeff Bourne again refused to comment Thursday - it is difficult to identify what the school's next move will be, although a source earlier said it intended to appeal Wood's initial ruling.
Asked Thursday if there were any indications that a settlement would be reached, Massie said he didn't know.
"I can't guess what JMU is going to do," he said.
Massie would not specify how much money Marist would seek in a settlement.
"For us, money is a secondary thing," he said last month. "The primary thing is honoring a contract."
The relationship between Brady and Marist athletic director Tim Murray had been splintering even before the coach left the Red Foxes for JMU in March 2008, sources say. Brady had signed a four-year extension with Marist in March 2007.
Massie said Murray attended the court proceedings Thursday.
Marist's lawsuit said its athletic director told Bourne on March 20, 2008, that there was no buyout in Brady's contract, but that Marist would grant him permission to leave if he agreed to "have no contact with or solicitation of current Marist men's basketball players and all Marist men's basketball recruits." Ok im a bit confused, what can Marist really get out of this case??? I doubt Marist can win recruits, naaa (haha) ....This sounds like a situation / thing of principle .. thats it. And It also seems like the Judge doesnt even know what to award Marist ..
